Goodbye to cookie walls, hello to explicit user consent

In May 2020, the General Data Protection Regulation (GDPR) was already two years old since its implementation in Europe . Coinciding with this anniversary, the European Data Protection Board (EDPB) updated the consent rules and gave three months to implement the new criteria. The deadline for this is next October 31, but there is still time : we tell you what implications the changes in the regulations have and how to make sure that your website or e-commerce is complying with it.

Changes included in the AEPD cookie guide
The Spanish Data Protection Agency (AEPD) has updated its cookie guide to include the latest changes, which are mainly:

It prohibits the so-called “cookie walls” used by some websites to obtain user consent in exchange for allowing them to browse. According to the EDPB, these walls, which operate in a similar way to interstitials, do not present the user with a choice and, de facto, force them to accept cookies. Therefore, the consent obtained through this formula is not valid and, in addition, the user may refuse to accept cookies without limiting access to the website.
Scrolling or simply browsing a website does not imply that the user gives consent for the collection of cookies. This must be given through an affirmative action such as clicking a button and browsing a website is not synonymous with this.

The AEPD cookie guide includes options for how information should be displayed on consent screens to comply with the General Data Protection Regulation. These should clarify what type of cookies are going to be collected and what the data obtained from users is going to be used for .

The aim is to avoid confusing messages that skirt the guidelines set out by the GDPR and end up violating it by not giving options or informing users correctly.
