Mandated reporters must file a report when they have reasonable suspicion of elder abuse or neglect. They must report by telephone as soon as possible, followed by a written report within two working days. The written report can be made via the confidential internet reporting tool.

Failure to report, or impeding a report, of elder abuse is a misdemeanor, punishable by a fine of up to $1,000, imprisonment for up to 6 months, or some combination of the two. Mandated reporters who fail to report elder abuse where the abuse results in death or ‘great bodily injury’ face the possibility of a year’s imprisonment, a fine of up to $5,000, or a combination of the two. Failure of an officer or employee of a financial institution to report financial abuse is limited to a $1,000 fine, or $5000 for intentional failure to report.
